T&Cs
1) Introduction
A contract is formed between a customer (referred to as the "Customer") and Low Light Baz (referred to as the "Company") when a Booking is received from the Customer. A Booking may be made in written, verbal, or electronic form. The term "Product or Service" refers to any product or service provided by the Company to the Customer. These terms and conditions do not affect your statutory rights.
2) Supply
The Company agrees to supply the product(s) or service(s) to the Customer as specified in the Booking, in accordance with the terms and conditions of this contract.
3) Rights Reserved
If the Company chooses not to enforce any or all of these conditions, this shall not be interpreted as a waiver of the Company's rights. By providing a Booking to the Company, the Customer agrees to be bound by these terms and conditions.
4) Payment
For projects involving photography with a value exceeding £1,000, the Company requires a deposit equal to the estimated shoot expenses. This deposit must be paid by the Customer to secure the shoot dates and confirm the booking.
The Company offers the following payment options:
1. Final Invoice on Delivery: The full payment is due within 30 days from the delivery of the final images or service.
2. 30-Day Rolling Terms: The Company may invoice for work completed to date every 30 days throughout the duration of the project.
3. Payment Plan: The Customer and the Company may agree on a payment plan, with terms outlined in the client proposal.
The payment terms for each option will be specified in the client proposal. The Company reserves the right to charge interest on overdue amounts at a rate of 10% per annum, calculated daily. Copyright of the goods or services remains with the Company until full payment is received, unless otherwise agreed in the Booking.
5) Health & Safety
The Company and the Customer will act in compliance with all relevant health and safety requirements to ensure the safe delivery of the product(s) or service(s).
6) Creative Brief
Unless otherwise agreed, the Customer accepts the Company's creative decisions regarding the product(s) or service(s).
7) Cancellation/Additional Work
If the Customer cancels or reschedules the shoot less than 2 weeks prior to the Company supplying the product(s) or service(s), the Customer will be liable for the entire value of any 'Kit' listed in the booking form.
If additional services are required to complete the contract, the Company will endeavour to notify the Customer before these services take place.
8) Liability
The Company accepts no liability for any loss or damage arising from the supply of the product(s) or service(s). In the unlikely event that the Company is unable to supply the product(s) or service(s) as specified in the Booking, liability will be limited to the total invoice value, or any monies already paid by the Customer.
9) Copyright
Unless otherwise agreed in the Booking, copyright of the final works will transfer to the Customer once full payment has been received for all services. The Customer is responsible for ensuring that they have obtained permission for the inclusion of any copyrighted material they supply to the Company to enable the Company to deliver the product(s) or service(s). The Customer must also obtain permission for the inclusion of any performers, trademarks, and locations.
The Company retains the right to use this material in its original or edited form as they see fit, unless otherwise specified in the Booking. This includes the right to use images for portfolio and promotional purposes. The Customer agrees to indemnify the Company in the event of any copyright infringement claims arising from material supplied by the Customer.
10) Data Protection
The Customer must ensure that all necessary permissions have been obtained from individuals and locations that may be photographed as a result of the Company supplying the product(s) or service(s), and that such photography complies with relevant Data Protection laws.
11) Complaints
In the unlikely event of a dispute regarding the supply of the product(s) or service(s), the Customer must notify the Company of any issues within 28 days of receiving the product(s) or service(s).
